Windows that endanger the city's bird population won't fly anymore.
The City Council passed a bill Tuesday mandating developers and rehabbers encasing buildings in glass to use material that the American Bird Conservancy has deemed friendly to urban avians, on at least 90% of the building's lower 75 feet.
The measure will also apply to any part of a structure where transparent interior or exterior structures might produce "the illusion of a void" that a bird might believe it could fly through.
Brooklyn Councilman Rafael Espinal, who sponsored the proposal, cited Audubon Society estimates that 90,000 to 230,000 fatal feathers-to-facade collisions occur in the five boroughs each year.
"This is a staggering statistic especially when we have a solution ready to go that can save the many lives of this vital part of our ecosystem," Espinal said. "This bill will add to our environmental legacy as we are taking responsibility for our role in the ecosystem that lasted long before towering skyscrapers."
Bird-safe glass usually has textured or reflective coatings that alert birds to the solidity of the structure they are approaching.
Council Speaker Corey Johnson admitted that few firms currently produce such glazing, making it more costly than traditional panes. But he noted that a number of jurisdictions have recently moved to require its use, which he hoped would boost demand and depress prices.
"This is a significant step in protecting our feathered friends, and making New York a more animal-friendly city," he said. "The hope is that when you have other big cities that put this requirement on, it's going to increase production of this, and hopefully bring costs down."
The rules will take effect in one year.
